Domestic violence: understandably “hot-button,” sensitive topic

Some allegations of criminal behavior can immediately seem more injurious than others to personal reputation and to the perception of an individual in the public’s collective mind, with domestic violence being one criminal charge that often breeds an outsized stigma.

Anything involving something as organic as the family and the intensely personal relationships that define it can be categorized as such.

We also opt to employ the term “sensitive,” because the facts in a given abuse case are not always immediately clear and irrefutable. Domestic violence claims are often brought during moments marked by high passion and explosiveness. Things are sometimes not what they appear to be.

It is imperative concerning any domestic violence allegation that stories be closely checked, medical reports and records scrutinized, accounts to police verified (or disproved) and personal motives considered.

As with any criminal law matter, a domestic violence case merits dispassionate probing and a methodical search for the truth. Absent due care, and especially in the context of a family violence-related charge, the bedrock and critically important principle embodied by the presumption of innocence can be materially undermined.

And that can work a gross injustice, especially in a case where a false allegation was leveled or where a “victim” might have had an axe to grind. Accusers sometimes stand to gain some advantage by making a claim, such as in a family law matter involving child custody or visitation. And defendants and their families are sometimes best served by an alternative-to-jail sentencing outcome.
